application, and associated written materials are owned by The
University of North Carolina at Chapel Hill (UNC-CH) and are
protected by United States copyright laws and international
treaty provisions. UNC-CH reserves the right and title to this
application and all subsequent copies, including title to this
application and to the medium on which it is encoded. The structure
and organization of the application are valuable confidential
information of UNC-CH and are licensed to you on a non-exclusive
basis. You may not give, sell, rent, or lease, or otherwise
transfer the application and accompanying written materials
to any person or entity. The Handouts and QuickStart sheets
may be printed, duplicated, and distributed for use with this
application only. You may not reverse engineer, decompile, recompile,
or disassemble the software.
This product is licensed for use in teaching medical students.
It is a copyright violation to use this product other than as
intended.
Disclaimer of warranty and limited warranty.
The application is provided "as is" without warranty
of any kind. The entire risk as to the quality and performance
of the program is with you. Should the program prove defective
you (and not UNC-CH) assume the entire cost of all necessary
servicing, repair, or correction.
Further, UNC-CH does not warrant, guarantee, or make any representations
regarding patient care, including the use, or the results of
the use, of the software in terms of correctness, accuracy,
reliability, currentness, or otherwise.
UNC-CH specifically disclaims all warranties, expressed or
implied, including but not limited to any implied warranties
of merchantability and/or fitness for a particular purpose or
that the use of the products will not infringe on any patent
or copyright. In no event will UNC-CH's liability for any action,
including personal injury, bodily harm, lost profits, incidental
or consequential damages arising out of the use of the application,
exceed the fee, if any, you paid for the software even if UNC-CH
has been advised of the possbility of such damages. Some states
do not allow the limitation or exclusion of liability for incidental
or consequential damages, so the above limitation or exclusion
may not apply to you.
This Agreement shall be interpreted under North Carolina law,
and North Carolina courts shall have jurisdiction over any disputes
arising hereunder.
