Per NIH <a href=\"https:\/\/grants.nih.gov\/grants\/guide\/notice-files\/NOT-OD-23-133.html\" target=\"_blank\" rel=\"noopener\">NOT-OD-23-133<\/a>, <strong>effective October 1 2023<\/strong>, NIH will require foreign subrecipients to turn over all records to the primary recipient at an agreed-upon frequency (e.g. once a quarter, once a month). Records may include:<\/p>\n<ul>\n<li>All lab notebooks<\/li>\n<li>All data<\/li>\n<li>All documentation that supports the research outcomes as described in the progress report<\/li>\n<\/ul>\n<blockquote>\n<h4><em><strong>Update to Outgoing Subrecipient Letter of Intent (LOI)<\/strong><\/em><\/h4>\n<p><em><strong>Key Changes to Comply with New NIH Requirements:<\/strong><\/em><\/p>\n<ul>\n<li>\n<h4><em><strong><a href=\"https:\/\/research.unc.edu\/sponsored-programs\/forms\/\" target=\"_blank\" rel=\"noopener\">Updated Outgoing Sub LOI Form<\/a> version date is 9\/11\/2023.<\/strong><\/em><\/h4>\n<\/li>\n<li>\n<h4><em><strong>Updated form is applicable for all proposal submissions with a start date on or after October 1, 2023.<\/strong><\/em><\/h4>\n<\/li>\n<li>\n<h4><em><strong>New certification language added when the prime sponsor is NIH and it is for a foreign subrecipient.<\/strong><\/em><\/h4>\n<\/li>\n<\/ul>\n<\/blockquote>\n<p>The <a href=\"https:\/\/research.unc.edu\/about\/administration\/\" target=\"_blank\" rel=\"noopener\">Office of the Vice Chancellor for Research<\/a> (OVCR) is currently working to develop guidance for the research community with the below parameters on roles and responsibilities.<br \/>\nOVCR Responsibilities:<\/p>\n<ul>\n<li>Office of Sponsored Programs (OSP) and Research Science and Security (RSS) will work to finalize guidance documentation<\/li>\n<li>OSP and RSS will serve as the primary point of contact with NIH for general compliance inquiries.<\/li>\n<li>OSP will coordinate and be responsible for agreement language and any requests concerning agreements from NIH.<\/li>\n<li><strong>Updated language added to new and amended outgoing subagreements with a start date on or after October 1, 2023<\/strong>.<\/li>\n<\/ul>\n<p>PI and Research Team Responsibilities:<\/p>\n<ul>\n<li>Ensure progress reports and all other required lab notebooks and data are consistently and completely uploaded in <a href=\"https:\/\/research.unc.edu\/systems\/labarchives\/\" target=\"_blank\" rel=\"noopener\">LabArchives<\/a> or otherwise collected, maintained, stored, and provided to NIH upon request.<\/li>\n<li>Sharing, when appropriate, draft language with foreign subrecipients to include in their letter of support.<\/li>\n<li>Working collaboratively with OSP and RSS to maintain subrecipient relationships including assisting in explaining the purpose and source of these new requirements.<\/li>\n<\/ul>\n<p>Resources<\/p>\n<ul>\n<li><a href=\"https:\/\/research.unc.edu\/2023\/09\/12\/updates-on-nih-policy-for-subawards-effective-october-1st\/\" target=\"_blank\" rel=\"noopener\">OVCR Updates on NIH Policy for Subawards<\/a><\/li>\n<li><a href=\"https:\/\/www.ecfr.gov\/current\/title-2\/subtitle-A\/chapter-II\/part-200\/subpart-D\/subject-group-ECFR031321e29ac5bbd\/section-200.332\" target=\"_blank\" rel=\"noopener\">CFR 200.332: Requirements for pass-through entities<\/a><\/li>\n<li><a href=\"https:\/\/grants.nih.gov\/grants\/policy\/nihgps\/HTML5\/section_8\/8.2_availability_of_research_results_publications__intellectual_property_rights__and_sharing_research_resources.htm\" target=\"_blank\" rel=\"noopener\">Availability of Research Results: Publications, Intellectual Property Rights, and Sharing Research Resources<\/a><\/li>\n<li><a href=\"https:\/\/grants.nih.gov\/grants\/policy\/nihgps\/HTML5\/section_8\/8.4.1_reporting.htm#Recipient\" target=\"_blank\" rel=\"noopener\">Recipient Reporting of Subrecipient Data and Executive Compensation Information for FFATA<\/a><\/li>\n<\/ul>\n<p>For questions or concerns on this new requirement, please contact Quinton Johnson at quinton@unc.edu.<\/p>\n<p>For questions related to specific proposals, please get in touch with your department\u2019s OSP Sponsored Projects Specialist or School of Medicine Sponsored Programs Office Grants Analyst.<\/p>\n<p>For all other general inquiries, email SponsoredPrograms@unc.edu.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Update on NIH Policy for Foreign Subrecipients September 12, 2023 The National Institutes of Health (NIH) has updated requirements for foreign subrecipients.
